By using the Website, you acknowledge that you have read, understood and accepted, without limitation or reservation, this document (hereinafter “General Terms and Conditions of Use” or “GTCU”). You also undertake to read the personal data and cookies charter available on this Website. Please note that if you visit other Total Group websites, different general terms and conditions of use and policies related to personal data protection, or any other document relating to the protection of personal data, apply to these websites. It is recommended that you carefully read their legal notices.

The companies within the Total Group have their own legal existence and independent legal status. The company publishing this Website (hereinafter “Website Publisher” or “Company”) belongs to the Total Group. “Total”, “Total Group” and “Group” generally refers to TOTAL S.E. and/or its subsidiaries and affiliates; a subsidiary is a company in which TOTAL S.A. directly or indirectly holds a majority of the voting rights. Likewise, the words “we”, “us” and “our” are used to refer to the Website Publisher or any company of the Total Group in general or to those who work for them. These expressions are also used where no useful purpose is served by identifying the particular company or companies. 2. Definitions

Terms and expressions identified by capitalization in the GTCU have the following meanings, whether used in the singular or plural:

  • “Application”: the transmission, by the Website, of a project as part of a Challenge or an unsolicited application as part of the “Innovation Topics”.
  • “General Terms and Conditions of Use” or “GTCU”: refers to the present terms of use, the purpose of which is to define the General Terms and Conditions of Use of the Website and which apply to all Users. 
  • “User” or “You”: means any person who browses the Website and uses the functionalities and services of the Website.

3. Use and Undertakings of the User

Each User of the Website certifies to comply with the GTCU and laws in force, in particular:

  • have the necessary skills and means to access and use the Website;
  • have verified that the computer configuration used does not contain any viruses and is in perfect working order.

4. Access to the Website

Access to the Website is possible 24 hours a day and 7 days a week, as long as there is no case of force majeure, possible breakdowns or any maintenance operation necessary for the proper functioning of the Website. 

In any event, the User acknowledges having the necessary skills and means to access and use the Website.

The User must have a computer or any other device with an Internet connection, the settings of which obviously allow the Website to function properly. He declares that he is aware of the risks and accepts them and acknowledges in particular that the information that passes through it or is stored on it may be intercepted or altered independently of the will of the Website.

The User is invited to take all necessary precautions to protect himself against the effects of a computer attack, in particular by adopting a secure and appropriate computer configuration, by installing regularly updated virus detection software.

5. Services offered by the Website

The Website offers to the User the following services:

  • « Innovation Topics »: through the « Innovation Topics » tab, the User may submit an unsolicited Application with a view to establishing a potential collaboration with the Company or any other entity of the Total Group. To do so, in the online form, the User shall enter certain amount of personal data as well as details about her or his company activity. 
  • « Challenge »: through the « Challenges » tab, the User may send her or his Application to respond to a specific call for projects or to participate to a concrete challenge, and previously defined by the Company. To apply, the User must complete an online form.
  • Management of information requests and contact: the User has the possibility to contact the Website for any information request, through the online contact form made available to him. 

The processing of personal data carried out within the framework of these services is carried out in accordance with the Personal Data and Tracers Charter.

6. Application Selection Process

Once the Application has been submitted via the registration form available on the Website (via the “Innovation Topics” or “Challenge” tab), the Company shall proceed with its review and reserves the right to reject any Application, without having to justify its rejection on any grounds whatsoever. 

7. Intellectual Property

7.1. Principle

All information or documents (texts, animated or static images, sounds, photographs, know-how, quoted products) displayed on the Website as well as all elements created for the Website and its general structure, are either the property of the Website Publisher or the Total Group, or are subject to use, reproduction and representation rights that have been granted to such. These information, documents and items are subject to laws protecting copyright insofar as they have been made available to the public on this Website. No license or any right other than to view the Website has been granted to any person with respect to intellectual property rights. Reproduction of Website documents is authorized solely as information for personal and private usage. Any reproduction and any use of copies made for other purposes is expressly prohibited and subject to the prior and express authorization of the Website Publisher. In all cases, the authorized reproduction of information displayed on the Website must quote the appropriate source and ownership.

7.2. Distinguishing Marks

Unless otherwise stated, company names, logos, products and brands quoted on the Website are the property of the Website Publisher or the Total Group, or are subject to use, reproduction or representation rights that have been granted for their benefit. They may not be used without the prior written consent of the Website Publisher.

7.3. Databases

Any databases made available to you are the property of the Website Publisher, which has the status of database producer. You are prohibited from extracting or reusing any qualitatively or quantitatively substantial part of the databases, including for private purposes.

7.4. Authorization to use the logos and materials downloaded from the Website

The User grants the Company and any other entity of the Group participating in the selection of the Applications, a non-exclusive, worldwide, free of charge license to use the logos and materials downloaded from the Website to enable the management and selection of the Applications. This information will only be used internally (via an internal platform) and only for the duration of the selection process.

In the event of a dispute relating to the interpretation and/or execution of the General Conditions of Use, the User has the possibility of resorting to a conventional mediation procedure or any other alternative method of dispute resolution.
